A MEMORIAL of an Indented Deed dated the Seventeenth Day of June One thousand Seven hundred and Sixty Two
made Between James Massy Dawson of the City of Dublin Esqre of the first Part
Mary Massy Dawson otherwise Leonard his Wife of the second part
James Daly of Carronnekelly in the County of Galway Esqre and John Leonard of the City of Dublin Esqre of the third part
reciting several Deeds whereby the said James Massy Dawson and Mary his wife hath agreed to live Separate and apart
and further reciting that the said James Massy Dawson and Mary his wife have Mutually agreed to put an end to all Differences and Disputes between them and to live and cohabit together
in Consideration whereof the said James Massy Dawson did Give Grant Bargain Sell Demise and set over unto the said James Daly and John Leonard
All That and Those the Town and Lands of Cappagh now set to Mr Patrick Grene at the yearly Rent of Two hundred and Fifty Pounds
the Lands of Ballycrane & Curderry sett to James Byrne and Aadolph Hobbs at the yearly Rent of One hundred and Seventy Pounds Sixteen Shillings and Three pence
The Lands of Lodge sett to Edward Shehee at the yearly Rent of One hundred and Three Pounds Two Shillings and Sixpence Situate and being in the County of Tipperary with the Rights Members Members and appurtenances thereunto belonging and the Reversion and Reversions yearly and other The rents issues and profits thereof and of every part thereof
To Hold the said Towns Lands and Prem[is]es with their appurtenances unto the said James Daly and John Leonard and the sevwr [survivor] of them his Heirs Executors Administrators & Assigns from the First Day of March Last for the Term of Ninety Nine Years if the said James Massy Dawson shall so long live at the yearly Rent of One pepper Corn if the same shall be demanded
upon Trust that they the said James Daly and John Leonard or the survivor of them his Executors Administrators and Assigns Shall out of the Rents issues and profits of the said premises and thereout pay to the said Mary Dawson the Yearly sum of Three hundred pounds for her sole and separate use during such time as the said James Massy Dawson and Mary his Wife shall Cohabit Together to be laid out by her in providing herself with Wearing apparel Cloaths and other necessarys for her person the same to be paid her yearly during the joint lives of sd James Massy Dawson & Mary his Wife in Two Equal half yearly payments on Every First Day of May and First Day of November the first payment to be made on the First Day of November next
and upon further Trust that in Case it shall happen that the said Mary Shall by any improper treatment of the sd James Massy Dawson be obliged to withdraw and live separate from him that then the said James Daly and John Leonard and the survivors of them his Executors Administrators and Assigns shall out of the rents issues and profits of said lands and premises pay to the said Mary Dawson the further yearly sum of Two hundred pounds Stg for her sole and Separate Use for her better Support and Maintenance the same to be paid by Two half yearly payments in manner aforesaid
and upon further Trust to pay the said Mary the sum of Forty Pounds a year for every Child or Children which the said James Massy Dawson shall beget on her that she shall maintain and Support during the time they shall live with her
and the said James Massy Dawson did by the said Indented Deed Covenant Grant and Agree for him his Heirs Executors and Administrators to and with the sd James Daly and John Leonard their Executors Administrators and Assigns that a Bill by him filed in his Majesties High Court of Chancery in Ireland against the said John Leonard and others should be forthwith dismissed and that several Bonds executed by Athanasuis? Nagale Denis Kane and Michael Howard therein mentioned amounting to the sum of Six thousand and Twenty Eight pounds Thirteen Shillings and Four pence should be forthwith handed over to the said James Daly and John Leonard and that they should receive the said sum and layout the same and the Interest arising therefrom in the Purchase of Government Securities in Great Britain until thereby the sum of Ten thousand pounds be Compleated for the Several Trusts following that in Case the said sum shall be Compleated in the said James Massy Dawson’s lifetime to pay the Interest thereof the said sum of Ten thousand pounds or such part thereof as will be made up shall be paid to the said James during his life and from and after his decease to pay the interest of the said sum to the said Mary Dawson if she survives the said James and after the death of the survivors and amongst the younger Son and Sons and Daughter and Daughters of the said James Massy Dawson on the Body of Mary his Wife in such manner as he should direct Limitt and appoint as by Deed with several other Covenants and Agreement
and which indented Deed and this Memorial are Witnessed by Wentworh Thewles Esqre Henry Cope & John Kelly Gents all of the City of Dublin

The above named Henry Cope maketh Oath that he is a subscribing Witness to the Deed wherein the above Memorial and sayeth he was the said James Massy Dawson Mary Mafsy Dawson and John Leonard duly execute the same Deed and also saw James Mafsy Dawson duly execute this Memorial to William Hall Gent Deputy Register on the Twenty First day of June 1762 at or near half an hour after ten
