Transcript:
A memorial of an indented deed bearing date the twentieth day of October one thousd seven hundred and and eighty three
made between Roger North of Kilbride in the county of Westmeath esquire of the first part
William Abernethy of Humefield & Thomas Gerrard of Parslickstown both in the said county esquires of the second part
Mary Gerrard of Parslickstown aforesd spinster of the third part
reciting that Thos Smith esqr by indenture bearing date the twenty second day of July one thousand seven hundred and fifty seven demised to Wm North gent decd all that part of the lands of Kilbride containg two hundred and twenty three acres be the same more or less, to hold for three lives renewable forever at the yearly rent therein mentd
and that said Wm North died having by his last will demvised said lands to his two sons the said Rogr North & Joseph North
and the said Joseph North by deed by him duly executed demised his part of the said lands to the said Roger North for three lives renewable for ever at the yearly rent therein mentd
and also reciting that a marriage was intended by the grace of god to be had & solemnized between the said Roger North and Mary Gerrard
the sd Roger North therefore in conson of the said marriage and the marriage portion therein mentd conveyed the said lands of Kilbride to the sd Wm Abernethy and Thomas Gerrard their heirs and asss for ever upon trust to the use of the sd Roger North for his life
& after his death if the said Mary Gerrard shod survive him & there shd be an issue of them living between them to permit the said Mary Gerrard to receive an anny of forty pounds for life and that such issue ... shod be intitled to said lands in such shares as the said Rogr North shod by deed or will appoint & for want of such appointmt equally and if no issue the heirs or asss of the said Rogr North to be intitled thereto but still subject to the said anny of sixty pounds or forty pounds as the case may be to the sd Mary Gerrard
which said deed and this meml are duly executed by the parties thereto in presence of and witnessed by Lewis Rochfort & John Rochfort both of sidebrook in the coy of Westmeath gents
