Transcript:
A memorial of an indd deed or declaration of trust bg date the 16 day of Sept 1815 made between
Abraham John Pilkington esqr Capt in his Majesty’s L Derry Regt of Militia and Mary Elizth Pilkington orse North his wife only daur and heiress at law of Roger North late of Kilbride in the county of Westmeath esqr deceased of the first part
Mary North widow her mother & guardian of the said Mary Elizth Pilkington of the 2nd part
& Jos North of Northbrook in the Co of Galway esqr of the 3rd part
reciting that by indd deed of lease and release, the release bearing date the 22nd day of July 1757, Thos Smith of Drumcree in the county of Westmeath esqr & said deed demised unto Wm North of Kilbride in said Co of Westmeath deceased all that and those that part of the town and lands of Kilbride & Tonlegee in the possn of sd Wm North contg in the whole 223 acres more or less situate in the Barony of Fertullagh & Co of Westmeath to hold unto the sd Wm North his heirs & ass for three lives therein named with covt for perpl renl subject to the yearly rent of £102-0-6 & a pepper corn renl fine on the fall of each life
and reciting that the sd Wm North by his last will & testament in writing duly attested devised the said lands to his two sons the said Roger North and … the sd Jos North equally share & share alike
& reciting that by indented deed of renewal made between William Smith of Drumcree in the county of Westmeath esqr and the sd Elizh Pilkington by her then name of Mary Elizh North by the said Mary North her mother & guardian he the sd Wm Smith renewed the sd lease unto the said Mary Elizth North now Pilkington to hold to her, her heirs and ass for three lives therein named and for such other lives as should thereafter be added to the said covt for rent
& witnessing that the sd Abraham Jn Pilkington & Mary Elizth Pilkington his wife and the sd Mary North as guardian of the sd Mary Elizth North did severally acknowledge & declare that the sd deed of renl was made & executed as to one moiety of the sd lands and premises, in trust for the use and benefit of the said Joseph North
which said deed and this meml are witnessed by Wm Abbott of the city of Dublin, atty at law & Fras Abernethy of Ballywilliam in the King’s county spinster
