Transcript: 

A Memorial of the indentured deed of agreement by way Of marriage Antisele bearing date the eleventh day of July in the year one thousand eight Hundred and twenty one between

Thorogood North and Dorothy North his wife and Thomas North his eldest son both of Coolemount in the King’s County gentlemen of the First part

the Reverend Henry Bayly of Rathangan in the County of Kildare clerk and Barbara Bayly his daughter of the second part

and Antisell North of Philipstown and Thomas Bayly of Rathangan aforesaid gent of the third part

whereby

after reciting an indenture bearing date the twenty fourth day of July one Thousand seven hundred and ninety six Charles William Burg late Earl of Charleville did devise and let unto Thorogood North all that and those that part of the lands of Coole being part of the lands of Croghan in said King’s County as then in possession of said Thorogood North containing one hundred and eighteen acres two roods and twenty five perches with the bog and commonage therewith belonging for and during the lives of the said Thorogood North Dorothea his wife and of said Thomas North and of the successors and survivors of these at the yearly rent of one hundred and fifteen pounds one shilling and eight pence payable half yearly as therein mentioned

and further reciting the intended marriage between the said Thomas North and Barbara Bayly therein named

and witnesseth that said Thorogood North for and in consideration of said intended marriage and of the sum of three hundred pounds the marriage portion of said Barbara paid and secured by said Henry Bayly to the said Thorogood North on the perfection thereof and also the consideration of two shillings to him the sd Thorogood North by said Antisell North and Thomas Bayly in hand paid the receipt whereof is thereby acknowledged

he the said Thorogood North did grant bargain sell assign transfer and make over reciting the lease for a year all that and those said lands of Coole containing one hundred and eighteen acres two roods and twenty five perches in said King’s County with the appurtenances thereto belonging to have and to hold unto the said Antisele North and Thomas Bayly and the survivors of these and the heirs of each survivor subject to the rents and Covenants therein mentioned for the lives therein named upon the Trusts

to permit and suffer the said Thorogood North until such intended marriage shall take effect to possess and enjoy all said lands and premises and from thenceforth until the first day of March these next …. the date of said Indenture

and from and after the said first day of March to permit and suffer the said Thorogood North his heirs and assigns for and during his life to possess all and enjoy said several lands and premises save and except that part of said lands adjoining the Grand Canal called Bryanagh containing forty eight acres of thereabouts as laid out by said Thorogood North and Thomas North

and upon the further Trust to permit and suffer said Thos North and his assigns from said first day of March these next for and during his life to have possess and enjoy that part of said lands of Coole adjoining the Grand Canal containing forty acres or thereabouts as aforesaid subject to the payment of the yearly rent of lease of twenty pounds unto said Thorogood North and his assigns payable half yearly as therein mentioned with the usual covenant as between landlord and tenant …..

to the said Dorothea North the content of her marriage settlement

and after her death the said Thomas North and his assigns are to hold the entire of said lands and premises freed of said rent and said Dorothea North’s Indenture and also chargeable with said sum of three hundred pounds sterling late Irish currency to be disposed of by said Thorogood North by deed or will as he may think proper with a power of distress

and in case of the death of said Thomas North said Barbara North is to have and to hold said forty acres aforesaid and after the decease of the said Thorogood and Dorothea North said forty acres of lands aforesaid is to be for the use of said Barbara and her issue by the said Thomas North

and further reciting the Bond of said Thomas North to the said named Antisele North and Thos Bayly payable at said Thomas North’s death which said Bond is to take precedence of any other creditor

which said deed and this memorial is also witnessed by Matilda Bayly of Tullamore in the King’s County gentlewoman and George Kennedy of Tullamore aforesd gentleman attorney at law

signed sealed and delivered in presence of Matilda Bayly Geo Kennedy   

Now Matilda Bayly of Tullamore in the King’s County gentlewoman aged twenty years and upwards maketh oath and saith that she is a subscribing witness to the deed of marriage settlement of which the above writing purports to be a memorial and that she saw said deed duly executed by the said Thorogood North Thomas North Henry Bayly Barbara Bayly Antisell North and Thomas Bayly executing party thereto

+ deponent saith that she was also present and did see the above memorial duly executed by the said Barbara North nee Bayly & of the said executing parties thereto

Matilda Bayly swears before me at Kilbeggan in the county of Westmeath this 25th day of Sepetmber 1837 by virtue of a commission to me directed from his Majesties Court of Common Pleas in Ireland for taking affidavits in the County
