Deed 1839 23 86 in the Registry of Deeds

Transcription:

A memorial of an indented deed of trust bearing date the ninth day of August in the year one thousand eight hundred & thirty nine made between

James North of William street in the city of Limerick gentn of the one part

Hickman North of Ballinas in the county of Tipperary gentn and Jane his wife of the second part

and the Revd Charles Mayne of Killaloe in the county of Clare clerk trustee named for the purpose therin mentd of the third part  

Reciting whereas Lancellott Lauds formerly of Kileavan in the King’s county deceased did by lease and release dated thirty first December one thousand seven hundred and sixteen and made between said Lancellott Lauds esquire of the one part and Nicholas Hannon of Bracklon in the King’s county Baronet of the first part for consons therein mentd sd deed demise grant let and to farm let unto the said Nicholas Hannon all that the mill of Bracklon together with the dwelling house lands gardens and said houses are held by William Cailibson therein mentd and situate lying and being in the lower half Barony of Philipstown in the King’s county aforesaid to hold unto said Nicholas Hannon his heirs exrs adminors and assigns from the first day of May then last past fee paid during the natural life and lives of the said Nicholas Hannon Margaret Hannon his wife and John Hannon elder son of the said Nicholas Hannon the survivor of them at the yearly rent of seventeen pounds six shillings payable as therein mentd

the which said indenture of leases cont a covenant for the perpetual renewal of said lease upon payment of four pounds fifteen shillings on the fall of each life as by said indenture of lease may appear 

and reciting the estate and interest of said Nicholas Hannon under and by virtue of the aforesaid lease in and to the premises thereby demised and the benefit of said covt for renewal by several rescue assignments became and were vested in said Hickman North and the … of said lands became and was vested in William Johnson of [blank]   

And further reciting that all the lives in said original lease have long since departed this life and the renewal and ….  fines payable by said recited lease hath amounted to the sum of one hundred pounds

and in order to preserve the interest in said promises under said recited lease it was agreed upon between the said Hickman North and James North [that James North] should pay and advance said sum of one hundred pounds

for the purpose of preserving the interest under said recited lease and thereupon obtaining a renewal of said lease to be granted to him the said James North as tenant or lessee

for the purpose of securing for the said Hickman North and Jane his wife the father and mother of the same James and for Mary Elizth Ellen William Jane and Martha the sisters and brothers of the said James the benefits therein mentd and subject thereto for the agreed behoof of the said James his heirs and assigns

and that said James North hath paid said William Johnson said sum of one hundred pounds and said William Johnson hath accordingly executed deed of said lands and premises to said James North for the natural life and lives of Her Most Gracious Highness Queen Victoria Prince George of Cambridge and the Marquis of Kildare and for and during the life and lives of the longest lives and survivor of them and for and during the life and lives of all and every such other person and persons as should from time to time forever thereafter be nominated by virtue of the covenant for perpetual renewal therein contained

said James North was desirous of conveying said agreement into effect and for that purpose agreed to execute said deed upon the laws therein mentioned

and that said James North had by said deed of which this is a memorial grant bargain alien transfer release and confer unto said Hickman North and Jane his wife a certain annuity of yearly rent charge of twenty pounds sterlg to be chargeable issuing and payable out of all that and those the said lands and premises as therein and herein before last day mentd To hold said annuity or yearly rent charge of twenty pounds sterling unto said Hickman North and his assigns during his life with remdr to said Jane North his wife and her assigns for her life in case she should survive said Hickman North payable by two even and equal half yearly payments  on the first May and first November in every year over and above all taxes whatsoever the first payment therein to be made on the first day of November next … the date of said deed

in which said deed … recital and contd covenants of distress and reentry in case of … event

and it is further determined by said deed of which this is a memorial that said James North covenanted for himself his exrs heirs admrs and assigns with said Hickman North his execrs and admors to charge said lands and premises the sum of twenty pounds for each of his sisters and brothers as follows that is to say this sum of twenty pounds to be paid to the said Mary Elizth Ellen William Jane and Martha in the manner therein …

and for the more effectualty  secu.. of the aforesaid annuities and charge of twenty pounds to each of said children the said James North did grant bargain sell and demise said lands and premises so charged with said annuity and said … sums of twenty pounds each unto the said Charles Mayne to hold the the same unto the said Charles Mayne his exors admors and assigns from the day next before the day of the date of said deed for the term of ninety nine years from thence next ensuing fully to be completed and ended before the said … therein mentd

and said deed was duly executed by the said James North in the presence of Thomas William Monsell of William street in the city of Limerick … and John Powell  of  Ladyland in said city afsd reciting clerk

and by the said Hickman North and Jane North the other perfecting parties therto in the presence of and witnessed by William Cordice and Nathaniel Cordice of .. in the county of Tipperary farmers

and this meml as to the execution thereof by the said James North is also witnessed by the said Thomas William Monsell and John Monsell
