Deed 1859 37 180 in the Registry of Deeds

Transcription:

A memorial of an indenture of lease bearing date the third day of November one thousand eight hundred and fifty nine made between

John North of Whitewell in the county of Westmeath esquire of the one part

and Laurence Gavan and Michael Gavan both of Old Town in the county of Westmeath aforesaid farmers of the other part

Said deed witnessed that for the considerations therein the said John North did demise grant set and to farm let release and confirm unto the said Laurence Gavan and Michael Gavan in their actual possession then being as therein mentioned and to their heirs and assigns all that and those the dwelling house office and demesne lands of Whitewell containing one hundred acres three roods late Irish plantation measure or thereabouts more or less being that portion of the said lands of Whitewell situate on the left hand side of the road leading from Rochfort Bridge to Dunboden Wall then in possession of said John North bounded on the west by Kilbride on the north by Mrs Cooper’s holding of Whitewell on the east by Nancy Egan’s building of Whitewell and the new road leading from Rochfort Bridge to Dunboden Wall and on the south by the said John North’s tenants & holdings of the town part of Whitewell situate lying and being in the barony of Fartullagh and county of Westmeath aforesaid respectively as therein    

To hold unto the said Laurence Gavan and Michael Gavan their heirs exrs admrs and assigns for and during the natural life and lives of Laurence Wheeler and Bryan Wheeler sons of John Wheeler of Robinstown in the county of Westmeath farmer and of the said Michael Gavan party thereto and the survivors and survivor of them or for and during the term of thirty one years to be computed from the first day of November one thousand eight hundred and fifty nine which ever of said terms of years or lives should longer last  subject to the yearly rent of two hundred and one pounds sterling payable half yearly on every first day of May and first day of November 

which said deed as to the execution thereof by said John North Laurence Gavan and Michael Gavan same is witnessed by William Gibson of Merrion Square in the city of Dublin solicitor and Thomas Travers of Bolton Street in said city clerk to said William Gibson

and the execution of this memorial by said John North is witnessed by the said William Gibson and said Thomas Travers

the above named Thomas Travers maketh oath and saith he be a subscribing witness to the deed of which the above writing is a memorial and also to said memorial and saith he saw said deed duly signed sealed and delivered and this memorial duly signed and sealed by the above named John North and saith the name Thomas Travers inscribed as a witness to the execution of said deed and memorial respectively is this deponent’s proper name and handwriting and saith he delivered said deed and memorial respectively to D V Fitzpatrick esquire assistant registrar in the Dublin registry office Henrietta Street in the city of Dunlin on Friday the fourth day of November one thousand eight hundred and fifty nine at or near twenty minutes to one o’clock in the afternoon of said day
