Deed 1867 10 12 in the Registry of Deeds

Transcription:

Memorial of indenture made the nineteenth day of March in the year of our Lord one thousand eight hundred and sixtyseven between

John Richard Somers of Friarsland in the county of Dublin esquire of the first part

Jeannette Gertrude Somers of Friarsland aforesaid … daughter of the said John Richard  Somers of the second part

Joseph Pim North esquire now a captain in Her Majesty’s 3rd Regiment of Hussars of the third part and

Samuel Handy Somers of Tyrrellspass in the county of  Westmeath esquire and David Bomford North of Fairview in the county of Westmeath esquire MD of the fourth part

Reciting that by deed poll bearing date the tenth day of December one thousand eight hundred and fifty three Mountefort Longfield Esquire LLD and Charles James Hargreave Esquire QC two of the commissioners for sale of incumbered estates in Ireland did for the considerations in said deed mentioned grant unto said John Richard Somers party hereto of the first part of the town and lands of Ballinderry Big containing four hundred and seven acres two roods and nine perches or thereabouts situate in the Barony of Moycashel and county of Westmeath to hold to the said John Richard Somers his heirs and assigns for ever and

And reciting that by a certain other deed poll bearing date of tenth day of December one thousand eight hundred and fifty three the said Mounteford Longfield and Charles James Hargreaves did for the considerations therein contained grant unto the said John Richard Somers certain other portions of the lands of Ballinderry Big containing fifty six acres one rood and sixteen perches or thereabouts situate in the Barony and county aforesaid to hold to the said John Richard Somers his heirs and assigns for ever

And after further reciting amongst other things that a marriage has been agreed upon between said Jeanette Gertrude Somers and the said Joseph Pim North

and that upon the treaty of said marriage it was agreed upon by and between

said John Richard Somers and said Jeanette Gertrude Somers on the one part

and Joseph Pim North on the other part

that the said John Richard Somers should grant and convey the several therein before recited lands and promises to the said Samuel Handy Somers and David Bomford North up the trusts thereinafter thereof declared

has by said memorialising indenture witnessed that in consideration of the said intended marriage and the nominal consideration therein mentioned

the said John Richard  Somers did grant unto the said Samuel Handy Somers and David Bomford North those parts of the town and lands of Ballinderry Big being the several lands and premises therein before recited and particularly described situate in the Barony of Moycashel and Co Westmeath and respectively conveyed to the said John Richard Somers by the several recited indentures of the tenth day of December one thousand eight hundred and fifty three

To hold the said premises respectively to the said Samuel Handy Somers and David Bomford North and their heirs to the use of the said John Richard Somers and David Bomford North and his heirs until the said intended marriage should take effect

and after the solemnization thereof then to the use of the said Samuel Handy Somers and David Bomford North their heirs and assigns upon the trusts therein declared of and concerning the same

which said deed and this memorial as to their execution respectively by the said John Richard Somers are duly witnessed by Edward Fetherstonhaugh of Clare Street in the city of Dublin and solicitor and the Rev James Campbell Connolly of Woolwich England Her Majesty’s Chaplain of Woolwich Dockyard

Now the above named Edwd Fetherstonhaugh of Clare St in the county of the city of  Dublin solicitor maketh oath and saith that he this deponent is a subscribing witness to the deed of which the above writing is a memorial and also to said memorial and saith he saw said deed and memorial respectively executed by the said John Richard Somers the granting party thereto and saith the name Edward Fetherstonhaugh subscribed as a witness to said and memorial [sic] respectively is this deponent’s proper name and handwriting and saith that on Thursday the twenty eighth day of March one thousand eight hundred and sixty seven at eleven minutes before two o’clock in the afternoon of said day he this deponent delivered said deed and memorial for registry to Thomas Matthew Ray esqire Assistant Registrar at Registry office Henrietta in the county of the city of Dublin
