Deed 1902 33 127 in the Registry of Deeds

Transcription:

A memorial of a deed poll of appointment dated the 14th day of April 1902 made by

David Trotter of Summerhill in the county of Meath esquire M D and

David North of Fairview Rochfordbridge in the county of Westmeath a Lieutenant Colonel in His Majesty’s army on retired pay

whereby

after reciting that Joseph Pim North by his will dated the eighth day of July one thousand eight hundred and eighty nine appointed John R Somers and the said David Trotter and David North his executors and trustees upon the trusts in said will and memorialising deed poll mentioned 

and reciting that said David Trotter and David North as surviving trustees of the will of the said Joseph Pim North were desirous of making such appointment of the first premises as was thereinafter contained

and after further reciting as therein

it was by memorial living deed poll witnessed that in exercise of the power given to them by the said will and in exercise of every and any other power them enabling the said David Trotter and David North thereby irrevocably appointed that the lands of Moyally and Tober otherwise Tubber situate in the barony of Kilcoursey in the King’s county being portion of the trust premises should henceforth be held upon the trusts thereinafter mentioned

and the said David Trotter and David North in further exercise of the said power thereby irrevocably appointed that all the rest residue and remainder of the trust premises should henceforth be held upon the trusts thereinafter mentioned

& which said deed and this memorial as to the execution thereof by the said David Trotter is witnessed by Oliver J Shannon J P spring Valley Summerhill Meath and D N Trotter Summerhill Meath farmer

and as to the execution of the said deed and this memorial by the said David North is witnessed by James Cuddy of Tyrrelspass pensioner R J C and William Somerville of Tyrrelspass coachman to Revd H N Joly

Signed and sealed by the said David Trotter in the presence of Oliver J Shannon J P Spring Valley Summerhill Meath 

D N Trotter maketh oath and saith that he is a subscribing witness to the deed of which this is a memorial and to this memorial saith he saw said deed and this memorial duly executed by the said David Trotter and saith the name D N Trotter subscribed as a witness to said deed and this memorial is this deponent’s proper name and handwriting

The within named James Cuddy maketh oath and saith that he is a subscribing witness to the deed of which this is a memorial and to this memorial.    Saith he saw said deed the this memorial duly executed by the said David North and saith the name James Cuddy subscribed as a witness to said deed and this memorial is this deponents proper name and handwriting

After Joseph Pim North died in 1894 his executors and trustees held his estate.  One of the trustees John R Somers has since died so in 1902 the estate is being managed by David Trotter and David North the remaining two trustees.  In this deed they are legally dividing the estate into two portions.  Moyally and Tober (or Tubber) are being transferred to one set of arrangements the 'trusts thereinafter mentioned' and the 'rest residue and remainder' are being transferred to a second set of arrangements (also 'the trusts thereinafter mentioned' but different from the first ones).  The memorial of the deed does not tell us what those arrangements (trusts) are or what the 'rest remainder and residue' comprises.  The original deed would have set it all out but the memorial has just referred to the deed without telling us what it says.  It does tell us that Joseph Pim North had Moyally and Tober when he died.
