Transcription:
To the registrar appointed by act of parliament for registering deeds Wills and so forth in Ireland
A memorial of an indenture of disentail made the second day of February one thousand nine hundred and five between
David North of Farview House Rochfortbridge in the county of Westmeath (herein and hereafter called the younger) Lieutenant Colonel retired of the one part and
David North Trotter of Summerhill Enfield in the county of Meath Esquire of the other part
reciting an indenture of settlement dated the 6th day of August 1845 (being the settlement made in contemplation of the intended marriage between John Roger North and Elizabeth Emerson [deed 1845 13 39])
and reciting the deaths of David North the elder Catherine North John Roger North Elizabeth Emerson and Emily Emerson
and reciting that said David North the younger was desirous of barring the intail in the lands tenements and hereditaments thereafter mentioned and in all other if any hereditaments of which he was tenant in tail male or in tail as thereafter mentioned
and of [ve]sting the same in himself in fee simple in possession in manner thereinafter appearing
It was witnessed that the said David North the younger did thereby grant unto the said David North Trotter
first all that and those the lands tenements and hereditaments conveyed in said indenture of settlement dated 6th August 1845
and therein described as that part of the lands of the west now in possession of the said David North or his undertenants, under and by virtue of the said lease and renewal thereof containing by Daniel Geraghtys survey thereof 61ac 1r 5p Irish plantation measure bounded on the north by the road leading from Tyrrelspass to Castlelost on the south of Oldtown[,] on the East by Castlelost af'd[,] and in the west by the widow Dunnes part of said lands of west[,] with a sufficiency of turfery in the bog of Kilbrennan for the use of said premises in proportion to the extent of said farm and the extent and quantity of said bog and the rights of said Ponsonby Moores other tenants in said bog situate lying and being in the Barony of Fertullagh and Co of Westmeath aforesaid
excepting and reserving as in the said recited release of 17th May 1821 and renewal of 8th October 1842 is excepted and reserved
and secondly all that and those that part and parcel of the town and lands of the island otherwise Clonkeen otherwise Castletown known as John Mulock's farm portion thereof and formerly in the possession of William Bermingham Michael Nowlan John Mollin and Bryan Hanlon together with the small callow formerly in the possession of Wm Donoghue adjoining Sewell Wetherall's ground containing in the whole 78 acres or thereabouts be the same more or less or whatever else the contents thereof may be with the bog thereunto belonging
and which said premises were formerly held and enjoyed by Elizabeth Mulock or those serving under her & part whereof are described and known as the Swangs of Kellypatrick and whether the sd several premises now are or heretofor have been known by the several denominations af'd or by whatever other denomination or subdenomination the same or any of them are or have been or may be known all of which said premises are situate lying and being in the Barony of Ballycommon in the Kings County
and all other if any freehold hereds of which the sd David North the younger was then by any means tenant in tail male in tail at law or in equity under sd Indre of settlement or otherwise
to hold the same unto the sd David North Trotter & his heirs discharged from all estates in tail male or in tail of the sd David North Trotter the younger at law or in equity and all estates rights interests and power to take effect after the determination of such estates in tail male or in tail
to the use of the sd David North the younger his heirs and assigns forever
which said deed and the memorial as to their respective executors by the said David North are witnessed by John P Connor Mullingar ironmonger ... ... E Graham Mullingar ironmonger ... and saw said deed as to the execution by David North Trotter witnessed by Edwr J Cannon J P farmer Grangevalley Summerhill Meath and Edwr Connor ironmonger

The above named John E Connor maketh oath and saith that he is a subscribing witness to the execution of the deed of which the foregoing is a memorial and to the said memorial saith he was present and saw said deed and memorial … duly executed by the said David North party thereto saith the name John E Connor … as a subscribing witness to said deed and memorial respectively is this deponent’s proper name and handwriting.
