Deed 1906 49 288 in the Registry of Deeds

Transcription

To the registrar appointed by act of parliament for registering deeds wills and so forth in Ireland Memorial of an indenture of conveyance dated the 6th day of June 1906 and made between

David North of Rochfort bridge county Westmeath Lieutenant Colonel in his Majesty’s army retired of the one part and

Patrick Gavin of West House Rochfortbridge aforesaid farmer of the other part

reciting the said David North is now absolutely entitled for an estate of inheritance in fee simple in possession of the hereditaments hereinafter described and expressed to be hereby granted

subject only to a perpetual yearly fee farm rent of £56.11.5 created by and to the covenants and conditions contained in an indenture of fee farm grant of the 31st December 1869 made between Blayney Townley Balfour of the 1st part Thomas Lee Norman of the 2nd part and John Roger North of the 3rd part

being a conveyance under the renewable leasehold conversion act in lieu of a lease for lives renewable for ever

and after further reciting as therein

it was by memoralizing indenture witnessed that in consideration of the premises and of the … of £815 paid to the said David North by the said Patrick Gavin [the receipt acknowledged] he the said David North as beneficial owner and [did?] thereby convey unto the said Patrick Gavin

all that the hereditaments and premises comprised in the said indenture of fee farm grant and therein described as “all that and those that part of the lands of West formerly in the possession of the said David North as aforesaid containing by Daniel Geraghty’s survey thereof 61 acres 1 rood and 5 perches Irish plantation measure bounded on the north by the road leading from Tyrrelspass to Castlelost on the south by Oldtown on the east by Castlelost aforesaid and on the west by the widow Dunne’s part of the said lands of West and as the same is laid down on a map or ter chart thereof on the said indenture of 17th May 1821 and also hereon endorsed

together with a sufficiency of turbary on the bog of Kilbrenan for the use of the said premises in proportion to the extent of said farm and the extent and quality of said bog and rights of said Blayney Townley Balfour’s other tenants in the said bog

all which hereby granted premises are situate lying and being in the barony of Fertullagh and county of Westmeath excepting and reserving as …. …. farm grant is excepted and reserved to hold the said hereditaments and premises unto and to the use of the said Patrick Gavin his heirs and assigns for ever … … other the estates and interest of the said David North under the therein recited agreement … … of November 1904 for the purchase of the interest of the said Blayney Raynell Townley Balfour …… …………. …………….. …………. …………. …………. ……………
