Deed 1870 37 155 in the Registry of Deeds

Transcription:

A memorial of an indenture dated the twenty seventh day of December one thousand eight hundred and seventy and made between

Roger North of Tyrrelspass in the county of Westmeath esquire of the one part

and David Bomford North of the same place esquire M D and Joseph Pim North of Ashmount Clara in the King’s county esquire of the other part

whereby

after reciting as therein

it is witnessed that

for effecting desire therein mentioned and in consideration of the annuity therein after mentioned and also of the natural love and affection which the said Roger North had for his relatives the said David Bomford North and Joseph Pim North and for other good considerations

the said Roger North did thereby grant and confer unto the said David Bomford North and Joseph Pim North and their heirs all that the said yearly rent of ninety five pounds ... reserved by the thereinbefore recited indenture of the twenty fifth day of April one thousand eight hundred and sixty five [sic: but this is probably the deed of 25 April 1805, 582 258 393193] payable out of all that part of the land of Kilbride called the East division situate in the Barony of Fetullagh and county of Westmeath thereinbefore described

and also all the estate and interest whatsoever of the said Roger North in the lands of Kilbride and Tonlegee

to hold the said yearly rent of ninety five pounds sterling and also all the estate and interest of the said Roger North in the said lands of Kilbride and Tonlegee therein before expenses

to be thereby granted unto the said David Bomford North and Joseph Pim North in equal [shares] as tenants in common and their respective heirs and assigns

and the said indenture did …

and it was thereby declared and agreed that the said grant was so made expressly that for an annuity or yearly rent charge of eighty seven pounds thirteen shillings and ten pence to be charged and made chargeable upon the said yearly rent lands and premises and to be paid to the said Roger North and his assigns for the term of his natural life in manner therein mentioned

which said deed and this memorial as to their respective execution by the said Roger North are witnessed by S Handy Somers gentleman of Tyrrelspass House Tyrrelspass in the county of Westmeath and by William Jones of Tyrrelspass aforesaid farmer

and which deed as to the execution thereof by the said David Bomford North and Joseph Pim North respectively is witnessed by the said S Handy Somers and said William Jones respectively

The withinnamed S Handy Somers maketh oath and saith he is a subscribing witness to the deed of which the foregoing writing is a memorial and also to said memorial and saith he saw said deed and memorial duly executed by the said Roger North and said deed by said David Bomford North and Joseph Pim North and saith the name S Handy Somers subscribed as a witness to the execution of said deed and memorial is this deponent’s proper name and handwriting
